Commercial litigation and dispute resolution

  • Commercial disputes.  I represent clients in commercial disputes with competitors, suppliers, customers, etc.  (For example, breach of contract claims, unfair competition claims, business defamation claims, intellectual property claims, etc.). 

  • Government agency actions.  I represent clients in disputes with government agencies, particularly disputes relating to IP and technology.  As an attorney at the DOJ, I represented the government in intellectual property actions asserted against various federal agencies and have tried cases in the Court of Federal Claims.

  • Importation matters involving IP.  I help clients navigate IP issues concerning imported products.  I represent clients in IP matters before the U.S. Customs Service and I have tried IP cases in the International Trade Commission, which was established to protect domestic industry from infringing goods imported from abroad. 

  • Infringement litigation.  I have decades of experience in intellectual property litigation, including patents, trademark, copyright, and trade secrets.  I have tried cases covering a wide range of technologies and industries.

  • Amazon Seller Disputes.  I help clients address disputes arising in the Amazon online marketplace to keep online competitors honest.  I have represented patent owners, accused sellers and have acted as the “neutral evaluator” in Amazon’s “Utility Patent Neutral Evaluation” process, which is a fairly new procedure for resolving patent disputes between Amazon sellers.

Intellectual Property Counseling

  • Pre-Dispute Counseling.  I counsel clients on potential disputes concerning patents, trademarks, copyrights, trade secrets, etc.

  • Freedom to Operate Counseling. I counsel clients on freedom to operate analyses, helping ensure that they avoid infringing IP belonging to others.

  • Technology Licensing.  I represent clients in technology license deals (drafting and negotiating the agreements).

  • IP Due Diligence. I advise clients on intellectual property IP issues arising in M&A due diligence analyses.
